These Terms and Conditions set out the basis on which Rubbish Clearance Shepherd's Bush provides waste collection and rubbish removal services to domestic and commercial customers. By booking a collection, you agree to be bound by these terms. Please read them carefully before confirming any service.
In these Terms and Conditions, the following expressions have the meanings set out below:
Service means any rubbish clearance, waste collection, loading, transport, disposal, recycling, clearance or related work provided by us.
Customer means the person, business or organisation booking the Service with us.
Premises means the property, site or location where the waste is to be collected or where the Service is carried out.
Waste means the items, materials, rubbish or refuse that you ask us to collect and remove.
Contract means the agreement between you and us for the provision of the Service, incorporating these Terms and Conditions.
We provide a waste collection and rubbish clearance service that includes arriving at the Premises, assessing the Waste to be removed, loading the Waste onto our vehicle and transporting it for lawful disposal or recycling. The specific scope for each booking will be confirmed based on the description you provide and any on-site assessment.
Our Service is intended for general household, garden and commercial rubbish, as well as other non-hazardous materials. We reserve the right to refuse any job that is unsafe, unlawful, impractical, or outside our standard capabilities.
We do not normally dismantle large structures, carry out building works, or perform specialist cleaning, unless expressly agreed in advance as part of the booking.
You can request a booking for our rubbish clearance services by contacting us via telephone or through our online or written enquiry systems where available. To arrange a collection, you will need to provide accurate information about:
The type of Premises and access arrangements.
The quantity, type and approximate weight of the Waste.
Any special items such as bulky furniture, appliances or dense construction waste.
Preferred dates and time windows for collection.
We may provide an estimated price based on the information you supply. This estimate may be confirmed or amended after our team has inspected the Waste on site before starting work. If you are not present at the Premises, you agree that a representative on site can confirm the scope and pricing on your behalf, or that we may rely on photographs or prior descriptions to adjust the price fairly.
Your booking is only confirmed when we have accepted it and issued a verbal or written confirmation. We reserve the right to decline a booking request at our discretion.
You are responsible for ensuring that we have safe, reasonable and lawful access to the Premises at the agreed time. This includes:
Providing correct address details and any necessary access codes or instructions.
Ensuring that any required parking or loading space is available or that any parking restrictions are communicated in advance.
Making sure that the Waste is clearly separated from items that are not to be removed.
If we cannot access the Premises or the Waste due to circumstances within your control, we may charge a call-out or wasted journey fee, and any rearranged collection may be treated as a new booking.
You must not include any prohibited, hazardous or regulated materials in the Waste unless we have expressly agreed in advance and any additional charges or requirements have been confirmed.
Our prices are generally based on factors including the volume and type of Waste, item weight, loading time, required manpower, access difficulty and any disposal or recycling costs. We may provide guide prices or estimates before visiting the Premises, but these are not binding until the Waste has been assessed on site.
Once our team arrives, they will inspect the Waste and confirm the final price before starting work. If the actual Waste differs significantly from the description provided at the time of booking, we may revise the price or decline the job. You will not be charged if we decline the job before any work has begun, save for any pre-agreed call-out fees.
Any additional work you request on the day that is outside the original scope may be priced separately. All prices quoted are inclusive or exclusive of VAT depending on our status and the information communicated at the time of booking.
Unless otherwise agreed, payment is due in full on completion of the Service at the Premises. We may accept payment by cash, debit or credit card, bank transfer or other methods as communicated at the time of booking. For business customers, alternative payment terms may be agreed in advance.
If payment is not made when due, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in pursuing the debt. Ownership of all Waste passes to us only after full payment has been received.
We may request a deposit or full pre-payment for certain bookings, especially larger clearances or where special arrangements are needed. Such payments are subject to the cancellation terms set out in these conditions.
You may cancel or reschedule your booking by giving us notice by telephone or in writing. The following cancellation terms will normally apply:
If you cancel more than 24 hours before the scheduled collection time, no cancellation charge will usually apply, unless we have incurred specific costs or ordered specialist services for your job.
If you cancel within 24 hours of the scheduled collection time, we may charge a reasonable cancellation fee or retain all or part of any deposit paid to cover our administrative and staffing costs.
If our team arrives at the Premises at the agreed time and is unable to carry out the work due to reasons within your control, we may charge a call-out fee or treat it as a late cancellation.
We will use reasonable efforts to attend your Premises at the agreed time and date, but times are approximate and subject to traffic, weather, operational and safety considerations. We reserve the right to cancel or reschedule a booking due to events outside our reasonable control. In such cases, our liability will be limited to rescheduling the Service or refunding any amounts you have already paid for the affected booking.
You must clearly inform us of the nature of the Waste when booking. We reserve the right to refuse or apply additional charges to certain materials, including but not limited to:
Hazardous or toxic substances.
Chemicals, oils, paints and solvents.
Asbestos or materials suspected of containing asbestos.
Medical or clinical waste.
Gas cylinders, fuel tanks or pressurised containers.
Contaminated soils or industrial residues.
Electrical items requiring special treatment or certification where not pre-agreed.
If hazardous or prohibited items are discovered within the Waste after collection, you may be liable for any additional handling, treatment, disposal and regulatory costs we incur as a result. We may also return such items to you if it is safe and lawful to do so.
Our team will carry out the rubbish clearance with reasonable care and skill, using appropriate equipment and methods. We will make reasonable efforts to avoid damage to your Premises while moving Waste, but you are responsible for protecting floors, walls, fixtures and other surfaces that might be vulnerable, especially in tight access areas.
You should remove or secure any fragile, valuable or personal items that could be affected during the loading process. We will not be responsible for items that are mixed with the Waste or left in close proximity where it is reasonable for our team to assume they are to be removed.
At the end of the clearance, we will leave the immediate work area in a tidy condition, but we are not responsible for detailed cleaning unless expressly agreed.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law.
Subject to the above, our total liability to you arising out of or in connection with any Service, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for that Service.
We shall not be liable for any indirect or consequential loss, loss of profit, loss of business, loss of data or loss of opportunity arising from or in connection with our Services or these terms.
We are not responsible for loss or damage to items that you have not clearly separated from the Waste or which were reasonably understood to be waste based on their location and presentation at the Premises.
You are responsible for any loss or damage suffered by us, our staff, vehicles or equipment arising from your breach of these Terms and Conditions or from unsafe conditions at the Premises that you knew or ought reasonably to have known about and failed to disclose.
We operate in compliance with applicable UK waste management legislation and regulations. We will transport and dispose of Waste only at authorised facilities and in accordance with our licences or registrations as required by law.
Where necessary, we may provide waste transfer documentation or receipts for the Waste collected. You agree to provide any information reasonably requested to ensure that the Waste is appropriately classified and treated under relevant regulations.
You confirm that you have the right to transfer the Waste to us and that it has not been obtained unlawfully. You agree not to request or permit us to dispose of any Waste in a manner that breaches environmental or waste management law.
We collect and use personal information such as your name, contact details and address in order to manage bookings, deliver Services, process payments and handle customer queries. We will store and process your information securely and only retain it for as long as is reasonably necessary for these purposes or as required by law.
We may use your contact details to provide information about our services, but you can opt out of marketing communications at any time by contacting us. We do not sell your personal data to third parties. We may share data with trusted service providers where necessary to operate our business or comply with legal obligations.
If you are dissatisfied with any aspect of our Service, you should contact us as soon as possible so that we can seek to resolve the issue. Please provide full details of your complaint, including the date of service, address and a clear description of the problem.
We will investigate complaints in a fair and timely manner and may request additional information, photographs or access to the Premises to assess the issue. Where a complaint is upheld, we may offer a remedy such as a partial refund, a re-visit or another reasonable solution, taking into account the circumstances of the case.
We may revise these Terms and Conditions from time to time to reflect changes in the law, regulatory requirements or our business practices. Any such changes will apply to new bookings made after the updated terms are published or communicated. The terms that apply to your Contract are those in force at the time your booking is confirmed.
No variation or addition to these Terms and Conditions is binding unless agreed in writing by us.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish clearance and waste collection services.
These Terms and Conditions, together with any written quotation or confirmation we provide to you, constitute the entire agreement between you and us in relation to the Service. You acknowledge that you have not relied on any statement, promise or representation that is not set out in these documents.
